KBR Announces Third Quarter 2009 Results

KBR announced today that third quarter 2009 net income attributable to KBR was $73 million, or $0.45 per diluted share, compared to net income attributable to KBR of $85 million, or $0.51 per diluted share, in the third quarter of 2008. Net income attributable to KBR for the third quarter of 2008 included income from discontinued operations of $11 million, or $0.07 per diluted share resulting from foreign tax credits related to the sale of KBR's 51% ownership interest in Devonport Management Limited.

Court Dismisses KBR from Two Electrocution Lawsuits

Federal Appellate Court Issues Significant Ruling in Contractor on the Battlefield Case

The Eleventh Circuit Court of Appeals affirmed in its ruling on Tuesday, June 30, 2009 in Carmichael vs. KBR that the Political Question Doctrine bars the plaintiff's suit alleging KBR is responsible for civil liability related to its activities as a contractor to the U.S. military under the Logistics Civil Augmentation Program ("LOGCAP") contract. The court affirmed in this case that the military, not civilian contractors, decides and directs the activities of contractors in battlefield situations and the Political Question Doctrine "excludes from judicial review those controversies which revolve around policy choices and value determinations constitutionally committed for resolution to the halls of Congress or the confines of the Executive Branch". In this case, the Eleventh Circuit held that adjudicating the plaintiff's claims would require re-examination and second-guessing surrounding the conduct of a military operation during a wartime environment.

KBR Announces Fourth Quarter and Full Year Results

KBR announced today that fourth quarter 2008 income from continuing operations and net income was $88 million, or $0.54 per diluted share, which included a $20 million, or $0.12 per diluted share, charge related to the final judgments which resolve the Department of Justice (DOJ) and Securities and Exchange Commission (SEC) Foreign Corrupt Practices Act (FCPA) investigations. This compares to income from continuing operations of $48 million, or $0.28 per diluted share, in the fourth quarter of 2007. Net income for the fourth quarter of 2007 was $71 million, or $0.42 per diluted share, which included income from discontinued operations of $23 million, or $0.14 per diluted share, related to post-closing activities for previously disposed businesses.
